JUDGEMENT

(1.)This petition is arising out of Crime No.5/2014 pending on the file of learned XXIII Addl. City Civil and
Sessions Judge and Spl. Judge for Prevention of Corruption
Act , Bengaluru, in Spl. C.C. No.41/2016. The petitioner is
shown as accused No.15 in the charge-sheet filed for the
offences punishable under Sections 409 , 420 , read with
120(B) of IPC and Section 21 read with 4(1)(A) of Mines and Minerals (Development and Regulation) Act , 1957 (for
short, ' MMDR Act ') and Rule 165 read with Rule 144 of the
Karnataka Forest Rules, 1969 (for short, 'Forest Rules').
1.2 The case of the prosecution in brief is that the petitioner who is accused No.15 entered into a criminal conspiracy with accused Nos.1, 2, 3, 11, 12, 13, and 14 and in furtherance of the said conspiracy, purchased illegally extracted iron ore measuring 1539.560 MT from accused No.11, and sold it to accused Nos.1, 2 and 3 without mining dispatch permit and without payment of royalty and other charges to the Mining and Geological Departments and Forest department, and thereby caused loss of Rs.23,48,409/- to the State Exchequer and thereby committed the charged offences.

Sessions Judge and Spl. Judge for Prevention of Corruption
Act , Bengaluru, in Spl. C.C. No.600/2015. The petitioner
is shown as accused No.5 in the charge-sheet.
2.2 The case of the prosecution in brief is that petitioner who is accused No. 5, being partner of M/s. B.C. Infrastructure Resources and Company, Bellary purchased 25500 MT of iron ore from M/s. Sai Krishna Minerals Pvt. Ltd., and from the stockyard of M/s. Saikrishna Minerals, without valid dispatch permit and forest permit transported the same to Belekeri Port and sold 20,322.85 MT iron ore to M/s. Taurian Iron and Steel Company Pvt. Ltd. and thereby caused a loss of Rs.3,33,53,101/- to the State Exchequer and thereby committed offences punishable under Sections 409 , 420 read with S.120-B IPC and Section 21 read with S.4(1) (A) of MMDR Act , and Rule 165 read with Rule 144 of the Karnataka Forest Rules.

Sessions Judge and Spl. Judge for Prevention of Corruption
Act , Bengaluru, in Spl. C.C. No.597/2015. The petitioner
is shown as accused No.1 in the charge-sheet filed under
Sections 409 , 420 , 471 read with 120(B) of IPC and
Section 21 read with 4(1)(A) of Mines and Minerals
(Development and Regulation) Act , 1957 (for short, ' MMDR
Act ') and Rule 165 read with Rule 144 of the Karnataka
Forest Rules, 1969 (for short, 'Forest Rules').
3.2 The allegations against the petitioner is that petitioner/accused No.1 entered into a criminal conspiracy with accused Nos.2 to 5 who were the partners of M/s.SB Minerals and M/s. Ramagopala Minerals and in furtherance of the said conspiracy, purchased 44912 MT of iron ore from M/s. Vaishnavi Minerals through M/s.Ramagopala Minerals and transported the same to Belekeri Port without obtaining the mineral dispatch permit and without payment of royalty and other charges to the forest department and thereby caused loss of Rs.1,22,03,534/- for the state exchequer.
