(1.)Shiv Kumar Jaiswal is before this Court assailing the order dated 21.1.2017 passed by the Civil Judge (Junior Division), Kanpur Nagar in Original Suit No.1064 of 2014 (Vijay Pal vs. Shiv Kumar) and the order dated 12.9.2017 passed by the District Judge, Kanpur Nagar in Civil Revision No.81 of 2017 (Shiv Kumar vs. Vijay Pal).
(2.)Record in question reflects that the plaintiff-respondent filed Original Suit No.1064 of 2014 (Vijay Pal vs. Shiv Kumar) against the defendant-petitioner for mandatory injunction in the Court of Civil Judge (Junior Division), Kanpur Nagar. The suit in question was decreed ex-parte on 27.4.2015. Thereafter the petitioner filed an application under Order IX Rule 13 C.P.C. for recalling the ex-parte decree and the said application was allowed on 6.2.2016 and the ex-parte decree was set aside. After exchange of pleadings the issues were framed and the issue nos. 2 and 3 were framed regarding valuation of the suit and as to whether the court fees paid is sufficient. The trial court decided the issue nos. 2 and 3 in favour of plaintiff-respondent on 21.1.2017. The petitioner-defendant filed Civil Revision No.81 of 2017 (Shiv Kumar Jaiswal vs. Sri Vijay Pal) assailing the order dated 21.1.2017. By the impugned order dated 12.9.2017 the District Judge, Kanpur Nagar has dismissed the revision in question, giving rise to the writ petition.
(3.)Learned counsel for the petitioner could not point out any manifest error apparent on the face of record in the impugned orders so as to justify interference by this Court in extra ordinary jurisdiction under Article 227 of the Constitution of India.
