JUDGEMENT

(1.)The petitioner is an accused in a case registered under Sections 406/420/34 I.P.C., Section 7 of the Essential Commodities Act, Section 29 of the B.P.S.C.P. Act, 1983 & Prevention of Corruption Act, 1988.
(2.)It reveals from the detailed written report that premises of M/s. Mahavir Prasad Sarawgi was inspected in presence of Supply Inspector, Bengabad and Supply Inspector, Jamua. It is alleged that a tanker having 2340 liters of diesel was found parked within the premises, where 1320 liters of kerosene oil in six drums were kept. Beside the above articles, instruments for measuring kerosene oil, empty drum, etc. were also found and seized. It was expected that the dealer had been intending to adulterate the diesel with kerosene oil. In course of raid, some representative of the dealer had been to the place on Endeavour car and they preferred Rs. 5 Lakhs to hush-up the matter.
(3.)Whereafter cash of Rs. 5 Lakhs and the said car were seized and representative of the said dealer were also arrested.
