JUDGEMENT

(1.)The grievance of the petitioner in this writ petition filed under Article 226 of the Constitution of India is to the action of the respondents in stopping the drilling works of the petitioner on behalf of the Atomic Minerals Directorate for Exploration and Research, Department of Atomic Energy, Government of India on the plea that there was non-renewal of Trade License under the Khasi Hills Autonomous District (Trading by Non Tribals) Regulation, 1954.
(2.)On 15.07.2019, when the case came up for hearing, reliance was placed by respondent No. 6 upon para 141 of the judgment of Apex Court in the case of State of Meghalaya v. All Dimasa Students Union, Dima- Hasao District Committee and Ors.: Civil Appeal No. 10720 of 2018 and the connected appeals wherein, the Apex Court had recorded that grant of licenses contemplated by Regulations are not required in respect of trade in mining of coal or mining operations. The order passed by this Court on 15.07.2019 is as under:-
"Learned counsel for respondent No. 6 referred to the judgment of the Apex Court in the case of State of Meghalaya v. All Dimasa Students Union, Dima-Hasao District Committee and Ors.: Civil Appeal No. 10720 of 2018 and the connected appeals decided on 03.07.2019. Reference was made to para 141 which reads thus;
"141. The grant of licenses contemplated by Regulations are only with respect to the "trade" as defined in 2(viii). The entire Regulations do not refer to any kind of trade in mining of coal or mining operations. Thus, the Regulations, 2011 have nothing to do with the mining of coal."
Learned counsel for respondents No. 1 to 3 prays for time to seek instructions.
Accordingly, the matter is deferred to 02.08.2019."
(3.)Learned counsel for the parties agreed and submitted that in view of the judgment of the Apex Court particularly, para 141 thereof, the writ petition has been rendered infructuous and the same be disposed of as such. Ordered accordingly.
