JUDGEMENT
P.S. Teji, J. -
(1.)The present petition under Sec. 482 Cr.P.C. has been filed by the petitioners, namely, Sh. Rakesh Verma and Smt. Maya Devi for quashing of FIR No. 315/2008 dated 20.08.2008, under Ss. 498A/406/34 IPC registered at Police Station Tilak Nagar on the basis of the compromise arrived at between the petitioners and respondent No. 2, namely, Ms. Sarika Verma.
(2.)Learned Additional Public Prosecutor for respondent -State submitted that the respondent No. 2, present in the Court has been identified to be the complainant/first -informant of the FIR in question by her counsel.
(3.)The factual matrix of the present case is that the marriage between the petitioner no.1 and the respondent no.2 was solemnized on 11.05.2005 as per Hindu rites and ceremonies. After the marriage, the in -laws of the complainant demanded Rs. 40,000/ - and the mother -in -law of the complainant took the jewellery worn by her. They also started taunting her for bringing less dowry. The husband of the complainant used to at times try to strangle her neck or at times he used to put a pillow of her face and prevent her from breathing. After some time of the marriage, the complainant was taken to the house of her sister -in -law, where also she was beaten up. After staying there for 2 months, the complainant was taken to her parental home and her husband also started living there with her. The husband of the complainant has not been going for work for the last 6 months and he started staying at his sister's place where he comes home drunk every night. The complainant then joined a job, but her husband used to come to her workplace in a drunken condition and used to abuse her parents.
The respondent no.2 preferred a complaint against the petitioners in respect of alleged offences vide FIR in question. Later on, the parties arrived at an amicable settlement. The petitioner no.1 and the respondent no.2 have already been granted divorce by mutual consent vide decree dated 07.07.2011 by the Court concerned.
