JUDGEMENT

- (1.)This petition is filed by the petitioner-accused under Sec. 439 of Cr.P.C., for granting regular bail in Crime No.12/2022 registered by Vidyanagar Police Station, Davanagere for the offences punishable under Ss. 302 , 201 of IPC now pending on the file of I Additional District and Sessions Judge, Davanagere in Crl.Misc.No.502/2022.
(2.)Heard the arguments of learned counsel for the petitioner and learned High Court Government Pleader for the respondent-State.
(3.)The case of the prosecution is that the complainant who is the father of the deceased filed a missing complaint on 19/1/2022 alleging that the accused said to be a relative and a marriage was fixed with CW.26 who is the daughter of CW.25. On 19/1/2022, the accused came to the house and took the deceased along with him for purchasing cloth for the purpose of marriage at Davanagere. On that day, both of them were not found and mobile phone of the accused and the deceased were switched off. Therefore, he filed a missing complaint of both accused and deceased. Subsequently, the dead body of his son was traced near the Mahalakshmi Layout, Kundavadi Road, Davanagere by sustaining injuries. Even then, the complainant has stated that his son was committed murder by somebody and still the whereabouts of Mohammad Ibrahim-this petitioner was not known. Subsequently, the petitioner said to be arrested by the Police on 26/1/2022 at Athani, Belagavi District and in the voluntary statement, the accused confessed the crime as he said to committed murder as the deceased said to be having illicit intimacy with CW.26, who is the one whom the petitioner wants to marry and where they have already got engaged. Therefore, he committed murder and took the Hero Honda Motorbike to the Hubli and parked in the Hubli KSRTC Bus Stand and left to Athani by Bus. After arresting the petitioner, the Police investigated the matter and filed the charge-sheet. His bail petition came to be rejected. Hence, he is before this Court.
